Court Nullifies APC Primary For Warri Federal Constituency,  Orders Fresh Primary Election

The Federal High Court sitting in Warri, Delta State has nullified the All Progressives Congress, APC primary for the Warri Federal Constituency in the forthcoming 2023 election conducted by the party in Warri.

The Federal High Court, Warri Judicial Division delivering judgement in Suit No.: FHC/WR/CS/34/2022 Monday November 28, 2022 by Justice O. Abang, in a matter involving Yabrade Moses V. APC & 2 Ors. The honourable Court ordered a fresh conduct of the primary election in Warri Federal Constituency race.

Areanewsng.com reports that the judgement coming from the Warri Federal High Court however sacks Mr. Emmanuel Ekpoto Ekpoto who was the former declared candidate of the party in the purported primary conducted .

Reacting to the judgement of the Federal High Court Warri Judicial Division the APC In compliance thereof and in tandem with the provisions of the Electoral Act 2022 (as amended), in a later addressed to the Independent National Electoral Commission, INEC, served December 1, 2022, signed by the party National Chairman Dr. Abdullahi Adamu and Sen. lylole Omisore read thus:

“We are in receipt of the judgement of the Federal High Court, Warri Judicial Division with Suit No.: FHC/WR/CS/34/2022 dated Monday, 28th November, 2022 in respect of Yabrade Moses V. APC & 2 Ors. wherein the honourable court ordered a fresh conduct of the primary election in Warri Federal Constituency of Delta State.

“We shall be adopting the Indirect Mode of primary election. The repeat primary is scheduled to hold on Saturday, 3rd and Sunday, 4th December, 2022 at the headquarters of Warri Federal Constituency, Delta State”.
