PIA: Court Upholds Host Communities’ recognition in NOGICD Act, not Kingdoms

The Federal High Court sitting in Abuja has upheld that the community where the operational activities of an oil and gas firm are taking place, reserves the hosting rights in such circumstance and should be engaged in that regard by the firm carrying out such operation.

The Buoye Omuso (Brown) Major House of Finima and Finima community in Bonny Local Government Area of Rivers State had file a suit before the court demanding to be recognised as the host community of the Nigeria LNG Limited, in line with Community Content Guidelines of the Nigerian Content Development and Monitoring Board, NCDMB, and the Petroluem Industry Act 2021.

Justice Donatus Okorowo, in his verdict on the suit No: FHC/ABJ/CS/1419/2022, ruled in favour of the Buoye Omuso (Brown) Major House of Finima, who are plaintiffs suing on behalf of themselves and the people of Finima Community.
Respondents in the suit are the Nigeria LNG Limited, Nigerian Content Development and Monitoring Board, NCDMB, the Federal Ministry of Petroleum Resources and the Nigerian National Petroleum Company Limited.
The plaintiffs among other reliefs had sought the court to declare Finima as the host community of NLNG and not Bonny Kingdom, just like the company had recognised Ogbum-nu-Abali community and Amadi-Ama community as joint host communities of its Corporate Head Office in Port Harcourt, and not Rebisi Kingdom or Okrika kingdom.

Represented by Amauche Onyedum, a Principal Counsel in Mike Ozekhome’s Chambers, the plaintiffs, who asserted in the said suit that they are founders and owners of all lands in Finima, sought and got all the reliefs granted to wit.

According to Sweet crude reports, some of the reliefs sought for are, “A declaration that the Plaintiffs, who sued in a representative capacity for themselves and on behalf of the Buoye Omuso (Brown) Major House of Finima, (founders of Finima, and owners of all lands in Finima) and Finima Community in Bonny Local Government Area, Rivers State, is the host community housing the NLNG Plant and other NLNG facilities, referred to in the 2nd Defendant’s letter dated 3rd March, 1978, with reference No: GPD.001/S.1/21 50230/225, same being their ancestral homelands.

“A declaration that it is, illegal, wrongful, unconscionable and unlawful for the defendants to refuse, neglect and fail to ensure due compliance with the provisions of Sections 25, 26, 27, and 28(2) of the Nigerian Oil and Gas Industry Content Development (NOGICD) Act, 2010, and Guidelines 1.0 to 7.0 of the Nigerian Content Development and Monitoring Board – Community Content Guidelines (NCDMB-CCG), 2017, as they affect the Plaintiffs’ land in their community before or after the commencement of work, or soon after the coming into effect of the instant Act and guidelines by the 3rd Defendant.

“An order of perpetual injunction restraining the Defendants, whether by themselves, their representatives, workers, servants, agents and/or privies howsoever called, from carrying out further works or operations on the site of the NLNG Plant in Finima Community until due and total compliance with the terms and conditions agreed upon by the Plaintiffs with the 3rd Defendant, the provisions of the NOGICD Act 2010, and the Nigerian Content Development and Monitoring Board – Community Content Guidelines (NCDMB-CCG), 2017, as well as other extant regulatory requirements.”
Reacting to the court judgement, the management of the Nigeria LNG Limited said the company’s lawyers were studying the court’s decision and will react at the right time.

NLNG General Manager, External Relations and Sustainable Development, Mr. Andy Odeh, in a statement, said company remains focused in ensuring and maintains a cordial relationship with its host community as a global gas firm.

“Nigeria LNG Limited is aware of a judgement by the Federal High Court sitting in Abuja on a case brought by the Buoye Omuso Brown House of Finima against Federal Ministry of Petroluem Resources, NNPCL, NLNG, and NCDMB, seeking the court’s interpretation in matters relating to host communities and the Petroleum Industry Act.

“NLNG wishes to state that its lawyers are studying the decision and will react at the appropriate time.

“Nigeria LNG remains focused on ensuring cordial relationship with its host communities and remains committed to sustainable community development, peace in its areas of operation as it continues to be a to globally competitive LNG company helping to build a better Nigeria,” the company said

Our revered leader, Alhaji Mujahid Dokubo Asari not barred from Presidential Villa any day– SEFFND

**Insist on decentralized award of Oil pipeline surveillance contract to accommodate all critical stakeholders, and all ethnic nationalities in the region

Militants from the six states of the Niger Delta region under the aegis of the Supreme Egbesu Freedom Fighters of Niger Delta (SEFFND) have dismissed as “false purported sponsored blackmail” the claim that the leader of Niger Delta People’s Volunteer Force, (NDPVF) and former President of Ijaw Youth Council IYC Worldwide, Alhaji Mujahid Dokubo Asari was barred from the Presidential Villa by President Bola Tinubu is fake and untrue.

According to SEFFND, though those behind the claims have been identified, and tag them as desperate contractors seeking renewal of their oil pipeline surveillance contracts, the claim is a calculated attempt to discredit the rising personality of Mujahid Dokubo Asari with the intention of putting a wedge between him and President Bola Ahmed Tinubu whom Dokubo has maintained a smooth cordial fatherly friendly relationship with over the years before he Bola Tinubu became Governor of Lagos state under AD party far back in 1999 before now, and their aim is to infuse bad blood between Dokubo and Bola Ahmed Tinubu and to fuel hostilities in the Niger Delta with falsehood and blackmail.

The SEFFND, in a statement signed by self-styled General Agadagba 1 also known along the creeks and waterways of the region as the River Don, stated that Alhaji Mujahid Dokubo Asari was not barred from the Presidential Villa,”the falsely claim ban against Dokubo Asari was a calculated attempt to discredit him with the intention of creating an imaginary rift between Dokubo Asari and President Bola Ahmed Tinubu led presidency through falsehood and cheap blackmail, wish will not stand no matter what.

General Agadagba 1 also known along the creeks and waterways of the region as the River Don, in the statement stated that after a meeting and proper brief on the issue with various leaders of the militant groups and their unit commanders, it was resolved that Alhaji Mujahid Dokubo Asari has paid the supreme price in the agitation for the emancipation of the Niger Delta question than any group of self acclaim Ex Militant Leader, who claim to be filed Marshall in the struggle, these are handiwork of envious mischief makers who didn’t believe in the candidature of Bola Ahmed Tinubu, and worked against him in the last presidential election in their states. And it is also known that these identified “mischief makers ” and ” desperate oil pipeline contractors” also played double game during the poll and lost their local government areas and various wards to the major opposition party PDP in the region. .It is obvious that they are envious of Alhaji Dokubo Asari taking up a notable position at the centre stage in the seat of power.”

“These series of attacks and cheap blackmail on Dokubo are necessitated just because of Dokubo’s stance in standing firm in support of the candidature of Bola Ahmed Tinubu of the APC against their prefferd candidate in the main opposition party in the region, and Dokubo to massively mobilize all his men to move to Abuja to be on ground in defence of the President Bola Ahmed Tinubu’s mandate at the presidential tribunal court to victory against all odds, attacks critics, and name calling but never deterd neither give up in standing for Bola Ahmed Tinubu, these persons are just mere detractors and frustrated disgruntled elements who just wants to benefit from a house they never joined to build from the beginning of the campaign to the election victory.

The group of the militant leaders also declare full support to the style of leadership being displayed by Alhaji Mujahid Dokubo Asari and will always stand side by side in support of him and in Defence of the President Bola Ahmed Tinubu Mandate no matter who’s ox is gose, and we stand to condemn the baseless, untrue and unfounded frivolous purported cheap blackmail orchestrated by mischievous mischief makers sponsored by some envious disgruntled and misguided elements who are enemies of progress that always take pride in pulling down any rising personality in the region by any means necessary with deliberate falsehood”.

“We know those who are behind the fake news, they are not comfortable with Dokubo Asari genuine concern and commitment to stand side by side in support of President Bola Ahmed Tinubu and for shunning every rebellious attacks and critics from some of these persons and their loyalist of misguided supporters in the region, and for him to stand for the betterment and the overall development of the Niger Delta region and the country in general”.

The militant groups also use the medium to emphatically congratulate President Bola Ahmed Tinubu (GCFR) for the landmark victory on the presidential tribunal judgement, these has re affirmed the mandate that the over 200 million Nigeria voters freely gave to President Bola Ahmed Tinubu on the 25th of February 2023 at the just concluded presidential poll, We also appraise the courage, fairness and the level of transparency of the tribunal judges in dispensing justice despite the media attacks and intimidation, name calling and threats from a broad spectrum of Nigerians.

In addition, the Militant group commended Dokubo’s huge concern in coming out openly with his group of soldiers in defending the electoral mandate freely given by Nigerians to President Bola Ahmed Tinubu from the onset of the presidential tribunal court case, and to occupy the tribunal court premises on the morning eve of the presidential electoral judgement without minding all the critics, media attacks and name calling abusive comments from mischievous Nigerians across board to this day tribunal victory is something worth commending, because this could be done by only a patriot and someone who uphold same religious faith as to what Dokubo Asari displayed so far.

The Group observed that some ex militants leaders just bent on securing the multi billion naira Oil Pipeline Surveillance contract by any means not minding what will be the next faith of Bola Ahmed Tinubu Mandate at the tribunal court case and to the supreme court level, rather their concern is to go around bribing with millions of dollars to get the attention of some powerful persons in the presidency and in the NNPCL towers to enable them re secure the multi billion dollar trans Niger pipeline surveillance contract that is just expired on the 29th of August, the question we are asking is why the rush, and why should somebody bribe if he is so competent, transparent and been fair enough to all ethnic nationalities in the region and fair to all critical stakeholders across board.

“Let me advice them to have a rethink and put a stop to these their belief of it is their right to take everything that come to the Niger Delta region alone at all times, because they don’t own Niger Delta, they did not sacrifice more than any other Ijaw sons and did not also own the oil and gas resources in the Niger Delta more than other ethnic nationalities in the region, because one of our highly respected reverd notable leader and stakeholder in the face of the Niger Delta struggle have been making huge sacrifices with his men, spending all hard earned resources and adequately mobilized for Bola Ahmed Tinubu’s 2023 presidential election project in the region from the beginning before the presidential election victory against all odds, we are not fools, and nobody owns Niger Delta more than us and we are the real face of the Niger Delta people’s emancipation struggle”.

“We wish to state it categorically and abundantly clear that we are also capable of handling such multi billion dollar pipeline surveillance contract Job even far better than they are currently doing in the region that is even one sided self benefactor and family business alike”

The statement added “the Militant group emphatically warn those desperate ex- militant leaders not allow us to spill the beans, because we have water tight informations with proofs of their illegal dealings and connivance with some top shots at the NNPC towers on how the so called celebrated 48b pipeline surveillance contract now turned to be 1.3billion dollars, wish is over a trillion.

Delta State Commissioner for Lands, Surveys and Urban Development, Chief Emamusi Obiodeh has called on Deltans to be patient with the Governor Sheriff Oborevwori administration, saying that the governor was determined to develop all parts of the state.

He made the call, on Monday in Asaba, when a delegation of his kinsmen from Igbide Kingdom, led by Odiologbo of Igbide Kingdom, Chief Godspower Okpohro paid him a congratulatory visit at his office.

He stressed that while the Oborevwori administration promised to do more for Deltans, the people must exercise patience with the administration as development cannot get to all parts of the state at once.

He commended the community leaders for their support for the Peoples Democratic Party (PDP) and for voting enmasse for Governor Sheriff Oborevwori and all candidates of the party in the last general election.

On the request for the construction of the Olomoro – Igbide Road, the Commissioner appealed for patience, saying “Gov. Oborevwori led administration is working tirelessly to meet his electoral promises to the people.

“The road you have asked for will bring meaningful development to the communities along that route and it is within the M.O.R.E Agenda of the Governor.

“Your request is germane but government cannot attend to everything at once so we have to be patient with the state government while we explore all avenues to get it approved for reconstruction.

“From the numerous achievements recorded by Governor Oborevwori in his first 100 days in office, I can assure you that working in synergy with all stakeholders across the state, a lot more will be done to advance the state in terms of infrastructural and human capital development,” Obiodeh stated.

Earlier, Spokesman of the group, Dr Abundance Ekaba told the Commissioner they were in his office to congratulate him on his appointment and urged him to appeal to the Governor for the construction of the Olomoro – Igbide Road.

He said the road was in terrible shape thereby making movements in and out of the community a very harrowing experience.

Prince Johnson Erijo where they congratulated them on their election and appointment and appealed for the construction of the road leading to the community.
